Given the complex legislative and regulatory framework, the current financial climate and the personal interest of members in ensuring the security of their retirement benefits, it is no surprise that pensions disputes are increasingly common.
For example, disputes may arise between trustees and employers; professional negligence may be alleged against a scheme’s advisers; members may make a complaint regarding their benefit entitlement.
There are a number of routes available when a complaint is made, ranging from mediation to court action. We can help to ensure that your dispute is dealt with in the most appropriate and cost effective forum.
If you are a member of a pension scheme and have a complaint, legal advice can be costly. We suggest that you first follow the scheme’s internal dispute resolution procedure. You can also contact the Pensions Advisory Service (TPAS), a voluntary service staffed by pensions experts, who can advise you free of charge. If there is a case to pursue afterwards, we will be happy to assist, agreeing an appropriate fee before undertaking any work.
If you are a sponsoring employer or trustee and need to consider taking or defending a legal action in respect of any dispute or issue then the Neon Legal team would be happy to review your issues and discuss your needs with you without charge. Following an appropriate review of your situation by our exceptionally experienced team (our Head of Pensions, Tushar Bhate, recently defended a claim for £20 million against an overseas employer which, after appeal, was settled for £60,000) we will advise you on the available options.
If you would like to discuss whether we would be able to help you or you would like a quote to compare our disputes service against your existing advisers, please contact Tushar Bhate or Paul Elliott on 0191 232 9005. Alternatively, you can email Tushar or Paul and they will contact you.
