Disputes

Given the complex legislative and regulatory framework, the current financial climate and the personal interest of members in ensuring the security of their retirement benefits, it is no surprise that pensions disputes are increasingly common.

For example, disputes may arise between trustees and employers; professional negligence may be alleged against a scheme’s advisers; members may make a complaint regarding their benefit entitlement.

There are a number of routes available when a complaint is made, ranging from mediation to court action. We can help to ensure that your dispute is dealt with in the most appropriate and cost effective forum.

If you are a member of a pension scheme and have a complaint, legal advice can be costly. We suggest that you first follow the scheme’s internal dispute resolution procedure. You can also contact the Pensions Advisory Service (TPAS), a voluntary service staffed by pensions experts, who can advise you free of charge. If there is a case to pursue afterwards, we will be happy to assist, agreeing an appropriate fee before undertaking any work.
